Evidence:

Following the running of Race 4 (SPEEDING SPUR AT WOODLANDS STUD TROT 2700m) Information No. A11104 was filed with the Judicial Committee. It alleged that Mr Jeffries the Driver of MAJESTIC STRIDE used his whip on more occasions than is permitted under the Whip Regulations over the final 400m of the event.

Mr Jeffries acknowledged that he understood the Rule, the Charge and confirmed that he admitted the breach.

Mr Mulcay showed the film replays and said that Mr Jeffries had used his whip 14 times between the 400m and the finish of the race.

Mr Jeffries agreed with the Stipendiary Steward’s assessment of his whip use.

Decision:

As the charge was admitted it was deemed proved.

Submission For Penalty:

Mr Mulcay said that Mr Jeffries had a clear record and that the 14 strikes sat within the second tier of the Penalty Guide.

Mr Jeffries said that he was sometimes hitting the shaft and cropper, but that what looks bad is bad.

Reasons For Penalty:

The film evidence was clear that Mr Jeffries had used his whip in breach of the regulations. It was noted that the JCA Penalty Guideline for 14 strikes of the whip has a starting point of $300. It was deemed that on this occasion that figure was an appropriate penalty.

Penalty:

Mr Jeffries was fined $300.
