Evidence:

Following the running of Race 8, the Carrier Arms Hotel Riverton Cup, Information A7772 was filed pursuant to rule 642(1) by Mrs S Price (Trainer of Motorbile Mike) alleging that the first placed horse by the Judge, Miss Three Stars (Miss S Wynne) interfered with the chances of Motorbike Mike (Mr R Cuneen) over the concluding stages of the race.

The official margin between first and second was a long neck.

The official Judges placings were.

The rule reads: 642(1)

If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.

Submissions For Decision:

Mrs Price used the various video clips to demonstrate to the committee where she alleged the interference to Motorbike Mike took place. She submitted that about 50 metres from the finish line, Miss Three Stars (S Wynne) has rolled inwards and has come into contact with Motorbike Mike (R Cuneen) who momentarily lost its momentum.

When questioned Mrs Price stated that she did not believe her jockey (R Cuneen) had to stop riding.

Mr Cuneen stated that he had kept his line from the top of the straight on Motorbike Mike. He stated his horse was in front about 150 metres from the finishing line and that Miss Three Stars has come into contact with Motorbike Mike about the 50 metre mark.

Mr Beckett submitted that in his opinion that the rider of Motorbike Mike was using the whip in the left hand and has run out as well as his horse running in, with both horses becoming unbalanced. He also stated that his horse was pulling away again at the finish, hitting the line strongly.

Miss Wynne stated that Motorbike Mike was never in front, her horse came in slightly at about the 100 metre mark with her mount losing momentum slightly as the horses came into contact. Her horse has kept going and finished off the race strongly.

Stipendiary Steward Mr Davidson was asked for his opinion of the incident. He stated that there was movement in from Miss Three Stars and there was one point of contact at about the 75 metre mark where both horses became unbalanced. Miss Wynne has taken hold of her mount where Mr Cuneen keeps riding.

Mr Davidson then concluded by stating that both horses had finished on.

Reasons For Decision:

We carefully considered the evidence given and the video coverage of the incident.

The Committee was satisfied that Miss Three Stars and Motorbike Mike had come into contact about the 75 metre mark from the winning post and that both horses had become slightly unbalanced.

However the Committee was not satisfied that this incident had a bearing on the outcome of the race. In our opinion Miss Wynne has had to stop riding momentarily to straighten her horse where Mr Cuneen has continued to ride out his horse.

We are also satisfied that Miss Three Stars was finishing the race off better than Motorbike Mike and that the margin between first and second, being a long neck was significant.

Decision:

The protest was dismissed.

It was ordered that the dividends and stakes be paid in accordance with the official result.
