Evidence:

This matter relates to the running of Race 8, the New World Whakatane 1600m. Prior to the running of this race it became apparent to the Stewards that Mr Elliot would not be able to fulfil his obligations to ride the horse NOTHING COMPARES at its carded weight of 54 kg.

Rule 330 (3)(c) provides that 'A Rider shall not fail to ride a horse at which it is handicapped to carry'

Mr Jones advised the Committee that rider Mr R Elliot had approached the Stewards early in the raceday to say that he would be unable to ride the subject horse at its carded weight and would need to be replaced by another rider.

Mr Elliot said that he had ridden at Christchurch the previous day, had not eaten or taken any fluids before attending the meeting at Te Teko. He added that he had been in a hot bath for over 1 1/2 hours that morning however his body was so devoid of fluids that he was unable to lose any weight at all.

Decision:

The charge has been established.

Submission For Penalty:

Mr Jones said that this was Mr Elliot's 3rd breach within 120 days, hence the necessity for a charge to be heard by the Committee had arisen.

Mr Elliot said that he had attempted to make the weight, however as stated earlier had been unable to do so.

Reasons For Penalty:

The JCA Penalty Guide provides a sliding scale for a breach of this Rule. Where a rider does breach it for the 3rd time within a 120 day period, as Mr Elliot has, a fine of $300 is indicated.

The Committee had some sympathy with Mr Elliot, however we advised him that we were unable to consider any concession for riders in his situation at the risk of compromising our consistency in imposing penalties.

Penalty:

Mr Elliot was therefore fined the sum of $300.
